The West Virginia Ethics Commission has cited a Union Public Service District official in Buckhannon for selling PSD-owned equipment on eBay.
Earl R. Burks sold a John Deere generator belonging to the PSD for $9,000 and attempted to sell other equipment on the website, according to a filing from the W.Va. Ethics Commission. Burks served as the assistant general manager and later became the general manager of the PSD. After commissioners for the PSD learned about the scheme, items that had been previously listed online for sale were removed from eBay. Burks paid $900 to the PSD as repayment for the John Deer generator, according to the filing. The complaint was referred to the commission's probable cause review board, which ordered a notice of investigation. Burks contacted the Ethics Commission and expressed his desire to cooperate with the investigation, said the filing.
The Ethics Commission ordered Burks to pay a $1,000 fine and to participate in training regarding the W.Va. Ethics Act in person or by commission's website within 90 days. Burks will also receive a public reprimand, according to the filing.
