The widow of an Ohio pilot killed when his plane crashed into a radio communications tower in June 2012 is suing the West Virginia Educational Broadcasting Authority, saying the agency should have known the risk the structure posed to air traffic.

Sharon Lee Lambert filed the suit in Kanawha County Circuit Court, though WVEBA has petitioned to remove it to federal court.

In the suit, Lambert points out her late husband, Richard, was the second pilot in nine years to die after striking the tower. She said her husband had been en route from Nemacolin to the Morgantown Municipal Airport when he struck the tower, which Sharon Lambert claims was improperly located directly in the flight path between the two airports.

“(WVEBA) owed a duty to (Lambert) to locate the subject communications tower in a position that would not impact a direct flight from Nemacolin Airport to Morgantown Municipal Airport,” the suit alleges.

The suit also points out the tower was equipped with markers and lights, but the National Transportation Safety Board's investigation “is silent as to whether or not the lighting...was functioning in the moments before impact.”

Sharon Lambert is seeking unspecified damages for pain and suffering, plus costs.
