UPDATE (11/12 at 3 p.m.):

A Salem man who was accused of sexually assaulting a 62-year-old woman had his charges dropped in Harrison County court Thursday afternoon.

The state dismissed the second degree sexual assault charge against Michael Nicholas.

The state found that video surveillance, which was not originally reported, did not put Nicholas or his car at the scene of the crime.

There was no physical evidence that Nicholas committed the crime or that the woman had been raped, the state said.
