The West Virginia Supreme Court of Appeals has reinstated Phillip Reese Bush's conviction for two first degree murder charges in connection to his 1983 conviction for the murders of Charles Dale Goff and Kathleen Jane Williams.
In a ruling issued Wednesday afternoon, the W.Va. Supreme Court of Appeals cites that the habeas court committed error in granting relief based on the trial court's substitution of 'first degree sexual assault' for 'rape' in jury instructions issued during the trial. As a result, the court reversed the Feb. 15, 2013 Circuit Court of Ohio order and reinstated the charges, according to the court filing.
Marion County Prosecutor Patrick Wilson said Friday the decision of the Supreme Court to reinstate the murder charges will not be final for 30 days. He will make a decision on whether or not to pursue Bush's charges in the 1974 Windmill Park murders at that time.
