Harrison County Circuit Judge John Lewis Marks Jr. dismissed an indictment against a Barbour County private investigator and a Wheeling attorney in connection to the trial of former Shinnston police officer Kevin Junkins, following a motion from the Harrison County Prosecuting Attorney's office.
Assistant Prosecutor Tracy Cook filed the motion in the case against Franklin Streets, 50, of Belington, and Paul Harris, 50, of Wheeling, on Thursday citing that two key witnesses for the state, Danielle Wilson and Carl J. "C.J." Wilson Jr., died in Sept. 2013 and Feb. 2014. Cook asserts that the prosecution can't provide the essential elements of the crime without the testimony of the two witnesses, according to court filings.
A Harrison County grand jury indicted Streets on felony charges including conspiracy to commit threats in official and political matters and misdemeanor charges that include conspiracy to commit witness intimidation and obstruction of a law enforcement officer.
