A special prosecutor has dismissed the charges against a man accused of killing his girlfriend's 14-month-old son in Feb. 2011 in Lewis County.
Michael Parker said he expects to present a new case to the grand jury next month.
Investigators said Christopher Sheppard was babysitting the boy and left him unattended in a sink.
The child fell out of the sink onto his head and later died.
An autopsy revealed several blunt force traumas to the child's brain, among other injuries.
Sheppard remains in jail on drug charges filed in Harrison County.
His next chance for release will come after the case is heard in July.
