A Lewis County man found to be incompetent to stand trial in the September 2010 shooting death of his father appeared in court Thursday.
William R. Sharpe, Jr. Hospital doctors and the defendant's attorney requested that Justin Gum be allowed to go on supervised outings into the community as long as he is supervised by two people from the hospital. Judge John Henning listened to testimony from psychiatrists at Sharpe who have been working with Gum. The Lewis County Prosecuting Attorney's office objected to the request.
Judge Henning said he would take the testimony under advisement and offered parties 20 days to submit further briefings before he will enter a decision.
Judge Thomas Keadle ruled in September 2012 that a jury would have convicted Gum of second degree murder.
