Equitable Gas will not drill in a Doddridge County flood plain.
The county commission issued EQT a flood plain permit, and then rescinded it after landowner Joye Huff objected.
Friday, Judge Tim Sweeney ruled the county's flood plain ordinance unconstitutional because it doesn't give fair notice to the landowners.
Huff said she's relieved by the judge's decision.
"I understand Equitables or any gas company wants to drill but production can't come at the expense of safety," Huff said. "That's been our whole purpose all along so we'll continue to fight for that, the county has a lot to get their ordinance in order."
EQT said it will ask the county commission to compensate it for the money it spent securing the permit.
