The U.S. Marshals Service from Pittsburgh, Pa., arrested Darnell "Nish" Carlton Bouie, 35, of Turtle Creek, Pa., at approximately 9:30 a.m. Friday, acting on information developed by Marshals in Clarksburg. Marshals surrounded a residence at 333 East Locust Street in Butler, Pa.
Bouie was taken into custody without incident, according to the U.S. Marshals Service.
Bouie was wanted by the Clarksburg Police Department on a first degree murder charge in the shooting death of Jayar "Trevor" Poindexter .
Bouie, along with Ennis Payne, are accused of shooting and killing Jayar "Trevor" Poindexter around 3:30 a.m. on January 13 2010, according to a criminal complaint document from the Clarksburg Police Department. Payne was arrested in early September 2012.
Surveillance video and individuals' statements placed both of the men in the Overlook Drive area at the time of the murder, according to police documents.
The Marshals Service had arranged with Bouie's attorney for Bouie to surrender on September 21, but he failed to do so.
"Bouie's failure to surrender was a mistake on his part. Bouie was given an opportunity to resolve the situation concerning the outstanding warrant by surrendering, but he chose instead to continue his flight from the law," said Alex Neville, Supervisory Deputy U.S. Marshal.
Bouie will be presented to a state magistrate in Pa., Friday and will await extradition to W.Va.
