The Monongalia County Commission voted two to one not to approve the annexation of the Morgantown Mall into the city of Westover.
This is the second time the issue has come before the county commission.
The mall opposed the annexation, but the city claimed it needed the revenue for pay for services it provides in the area, like police patrol.
This was the first time Commissioner Eldon Callen has weighed in.
"Is it in the best interest of the county to take people who make business plans and put new taxation on them at this time when; I understand how this would benefit Westover but it doesn't benefit the county as a whole," Callen said. "That's how I made my decision."
The mall's attorneys later issued a statement saying they "are pleased with the outcome of this important matter."
Westover officials did not comment. The city may still appeal the decision to circuit court.
